Terms of Service

1. Agreement
These terms form a contract between OstravaMenu, Inc. (“we”) and the business that subscribes to the platform (“you”). Creating an account or using a generated QR code means you accept them.
2. Subscription and billing
Plans are billed monthly or annually per location in advance. Prices shown on our pricing page are in US dollars and exclude applicable sales tax. You may cancel at any time; the subscription then stays active until the end of the paid period and is not refunded pro rata.
3. Tips and payouts
Tips paid by guests belong to the staff member or tip pool the venue designates. We charge no commission on tips; the payment processor's card fee applies and is shown before each payout. You are responsible for declaring and distributing tips in line with local employment and tax law.
4. Your content
You keep all rights to menu text, prices and photography you upload. You grant us a limited licence to host and display that content to your guests. You confirm you have the right to publish every allergen statement, price and image you upload.
5. Acceptable use
Do not use the platform to publish unlawful content, misrepresent prices, collect payments on behalf of another business without authorisation, or attempt to probe, scrape or overload our infrastructure.
6. Availability
We target 99.9% monthly availability for the guest-facing menu. Planned maintenance is announced at least 48 hours in advance and scheduled outside peak service hours where possible.
7. Liability
To the extent permitted by law, our total liability in any 12-month period is limited to the subscription fees you paid during that period. We are not liable for lost profits or indirect damages.
